Data protection is about your fundamental right to privacy. Kildare and Wicklow ETB has always kept your personal information safe and confidential.

The EU General Data Protection Regulations or ‘the GDPR’ came into effect on 25th of May 2018 and it replaced the existing Data Protection Laws in the European Union. The reason for the change is to give people more rights, control and understanding of how their personal data is being used.

The GDPR will have no impact on the services we provide to you.

It does however require Kildare and Wicklow ETB to keep you informed of the following:

  • The types of data we hold about you;
  • The purpose it is used for; and
  • Your rights in relation to how it is processed.

Kildare and Wicklow Education and Training Board (KWETB) is the state education and training authority for the Kildare and Wicklow region established by the Education and Training Boards Act 2013. To fulfil its statutory obligations Kildare and Wicklow ETB gathers, stores and processes large amounts of data on a variety of data subjects. This would include students, learners, staff, third parties and members of the public. This personal data can range from some personal details and CCTV footage to financial transactions. Personal data is any data that permits an individual to be identified.

Kildare and Wicklow ETB is committed to a policy of protecting the rights and freedoms of individuals with respect to the processing of their personal data.

Kildare and Wicklow ETB Obligations under GDPR

The Data Protection regulations and legislation require the staff of Kildare and Wicklow ETB to process data fairly and to ensure the security of that data.  
Kildare and Wicklow ETB is required to:

  • explain why personal data is being gathered
  • outline the purpose for which it will be used
  • only gather the minimum amount of data necessary
  • inform persons whether KWETB will share data with anyone else
  • only keep data for as long as it is needed
  • protect data from loss or theft
  • keep data accurate and up to date

GDPR places restrictions on what Kildare and Wicklow ETB is allowed to do with personal data such as passing personal information on to third parties, transferring information outside the EU or using it for direct marketing.

GDPR also provides individuals with important rights. GDPR therefore:

  • reinforces the right of a person to ask for a copy of all personal data held relating to them personally
  • gives a right to object to direct marketing practices,
  • allows a person to ask for inaccuracies in their personal data to be corrected,
  • give a right to data portability,
  • in certain cases it allows for personal data to be erased,
  • gives the right to seek compensation through the courts where privacy rights have been infringed.

Under the new legislation the digital age of consent has been set at 16. This means that social media and other online companies will need parental consent where they wish to use the personal data of a child under the age of 16 for marketing purposes or for creating personality profiles.

Making an Access Request

A data subject can exercise the right of access at any time by contacting Kildare and Wicklow ETB’s Data Protection Office in writing.  This can be done via email to dataprotection@kwetb.ie, or via post to Kildare and Wicklow Education and Training Board, Level 5, Áras Chill Dara, Devoy Park, Naas, Co. Kildare.  A Data Access Request Form will be provided. Access requests regardless of Kildare and Wicklow ETB School or Centre should be sent to the Data Protection Officer of Kildare and Wicklow ETB.

The data access request should include identification in order to protect the data requested, and so that Kildare and Wicklow ETB can satisfy itself of the identity of the requester.  The data access request is required to be accompanied by one of following identity verification methods:

  • a copy of State Identification (Passport or Drivers Licence) officially verified with the station stamp and signature of a member of An Garda Síochána. Or
  • The requestor can present themselves with their identification to the Administration Offices in Kildare and Wicklow ETB
  • The requestor can include a declaration from a Commissioner of Oaths verifying their identity.

Upon receipt of all relevant documentation, Kildare and Wicklow ETB will process the Data Access Request within 30 calendar days.

Please note that in accordance with Data Protection Legislation, Kildare and Wicklow ETB can only release the data belonging to the requester. The data of all other individuals other than the requester will be redacted where necessary. CCTV footage will be pixilated to protect the identifiable data/images of all other parties. Due to COVID-19, Kildare and Wicklow ETB are working, in the main, remotely therefore we ask you to bear this in mind in the event of making an access request. As an organisation, due to the impact of COVID-19, there is a possibility we cannot respond to a request in full or in part within the usual 30 days period and shall be in contact with the data subject if this is the case. The GDPR provides for an extension of two months to respond to a request where necessary taking into account the complexity and current workload. Important notice to Parents/Guardians
Parents/Guardians making a Data Access Request for copies of data held about their child (student under 18 years) should read and familiarise themselves with the Data Protection laws surrounding these requests. Section 3, (3.1 (a), (b) and (c)) of KWETB’s Data Protection Policy details more information on this process within KWETB Schools and Centres.

Access requests regardless of Kildare and Wicklow ETB School or Centre should be sent to the Data Protection Office of Kildare and Wicklow ETB.
